The Drug Enforcement Administration (DEA) and the prohibitionist group Smart Approaches to Marijuana (SAM) have categorically denied allegations that they illegally conspired together during the Biden administration's marijuana rescheduling process.
In a response to a motion seeking to remove DEA from the rescheduling proceedings over alleged ex parte communications with SAM, the agency on Monday said it "unequivocally denies" the charge and requested a dismissal of the motion from Hemp for Victory and Village Farms International.
"Movants' own evidence fails to demonstrate that any unlawful ex parte communication took place," DEA said in its brief with the administrative law judge (ALJ) overseeing the case. "The Movants would have this tribunal embark on a fishing expedition in search of evidence to support these sweeping, unsupported claims, which at best can be categorized as gossip, not ex parte communications."
The original filing included screenshots of social media posts where the group's president, Kevin Sabet, indicated he had private conversations with DEA officials about the rescheduling effort as SAM rallied opposition to the reform and urged the agency to keep marijuana in Schedule I.
One week prior to DOJ's publication of the proposed rule, Sabet posted on X that he could confirm DEA Administrator Anne Milgram wouldn't sign the notice, citing "two confidential sources inside DEA and another outside DEA with intimate knowledge."
The agency said that doesn't amount to ex parte communications, however.
"The tribunal correctly questions the seriousness of the remedies sought by the Movants and as such, should deny the motion," it said in the new filing, referring to comments from the judge last week. DEA added that the cannabis organizations behind the motion failed to "identify any precedent that would support removing an agency from its own rulemaking process."
"The only authority cited by the Movants on this point simply supports the notion that specific individuals may be removed from the proceeding under the appropriate circumstances," it said, pointing out that there is no accusation of any wrongdoing by DEA attorneys involved in the current proceedings on rescheduling. "In short, the Movants' arguments are completely without merit."
SAM also filed a response with the ALJ on Monday, arguing that the allegations "fail on their face to suggest any improper contacts between SAM and the DEA," and therefore they "can and should be quickly dispensed with by this Tribunal."
The organization asserted that, statutorily, unlawful ex parte communications would need to have occurred after the Justice Department posted its notice of proposed rulemaking, which is not explicitly alleged in the original motion.
"Standing alone, that deficiency itself is sufficient to dismiss Movants' speculation about supposed improper contacts," it said.
SAM also cited media reports from outlets including Marijuana Moment and The Wall Street Journal, as well as social media posts from supporters of the rescheduling effort, that contained information about the process that had not yet been made publicly available. It argued that such reporting undermined the allegation that Sabet's communications were uniquely improper.
"In short, the Motion is a transparent effort to smear both SAM and the DEA in an attempt to eliminate from this proceeding one of the strongest voices opposing rescheduling of marijuana," SAM said. "The Tribunal should deny Movants' invitation to create a sideshow requiring SAM and its counsel to expend more time and funds defending against unfounded attacks and instead should permit SAM to focus on the merits of these proceedings."
After the motion was filed with DEA ALJ John Mulrooney, <a href="https://www.marijuanamoment.net/dea-judge-gives-agency-one-week-to-address-allegations-of-illegal-talks-with-marijuana-opponents-amid-rescheduling-process/">the judge invited both the agency</a> <a href="https://www.marijuanamoment.net/dea-judge-invites-prohibitionist-group-to-explain-allegedly-unlawful-talks-with-agency-amid-marijuana-rescheduling-review/">and SAM to respond</a>, calling the nature of the alleged illegal communications "serious."
This comes just weeks before an initial December 2 hearing before the ALJ on the government's proposal to move marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA).
In a historic first, it was Attorney General Merrick Garland—and not DEA's Milgram—who signed the proposed rule to reschedule cannabis. The original motion said that fact, as well as DEA's apparent indecision on the proposed rule, warranted a change in the hearing structure.
The judge, in turn, said that the prospect of removing an agency head from rulemaking that it is responsible for overseeing would likely, "and correctly," be deemed beyond the ALJ office's jurisdiction.
Last week, Mulrooney officially ruled on <a href="https://www.marijuanamoment.net/dea-judge-issues-order-approving-and-denying-witnesses-for-marijuana-rescheduling-hearing-and-laying-out-next-steps/">which of the agency's 25 selected witnesses for the hearing will be able to participate</a>, while laying out the procedure for the administrative process—including how pro- and anti-reform speakers will be able to cross-examine one another.
Separately, the judge last week <a href="https://www.marijuanamoment.net/researcher-asks-dea-judge-to-postpone-marijuana-rescheduling-hearing-until-after-trump-takes-over/">denied a request from a cannabis and psychedelics researcher</a> to postpone the upcoming rescheduling hearing over the agency's alleged "improper blocking" of witnesses, while arguing that the process should be halted at least until President-elect Donald Trump's administration comes into power so it can review the rulemaking.
Mulrooney also <a href="https://www.marijuanamoment.net/dea-judge-rejects-veterans-groups-petition-to-participate-in-marijuana-rescheduling-hearing/">rejected a veterans group's petition to participate in the rescheduling hearing</a>, which the organization called a "travesty of justice" that excludes key voices that would be affected by the potential policy change.
For what it's worth, Vice President Kamala Harris said recently that part of the reason for the delay in the administration's marijuana rescheduling effort is&nbsp;<a href="https://www.marijuanamoment.net/kamala-harris-blames-marijuana-rescheduling-delay-on-dea-bureaucracy-while-defending-her-own-prosecutorial-record/">federal bureaucracy that "slows things down," including at DEA.</a>
In March, Harris also expressed some frustration with the bureaucratic process of rescheduling marijuana, prior to DOJ's formal recommendation,&nbsp;<a href="https://www.marijuanamoment.net/watch-live-vp-harris-talks-marijuana-ahead-of-white-house-meeting-with-cannabis-pardon-recipients/">calling on DEA to expediently finish the job</a>.
While the Biden–Harris administration facilitated the review that led to the DOJ rescheduling proposal, Trump has also voiced support for the reform.
In Congress, numerous lawmakers have shared their own perspectives on the proposed reform with DEA and DOJ since the Schedule III announcement was made.
In August, for example, Sen. Chuck Grassley (R-IA)&nbsp;<a href="https://www.marijuanamoment.net/gop-senator-demands-answers-on-rush-to-reschedule-marijuana-from-top-biden-administration-officials/">raised concerns about the Biden administration's justification</a>&nbsp;for recommending marijuana rescheduling, demanding answers to questions from federal agencies about how they arrived at that decision in what he described as a rushed and unconventional administrative process.
A week earlier, top Democratic senators—including&nbsp; Senate Majority Leader Chuck Schumer (D-NY)—sent a separate letter to DOJ's Garland and DEA's Milgram urging the agencies to&nbsp;<a href="https://www.marijuanamoment.net/schumer-booker-and-other-senators-push-dea-to-promptly-finalize-marijuana-rescheduling/">"promptly finalize" the rule to reschedule marijuana</a>.
While rescheduling would remove certain research barriers and free up state-licensed cannabis business to take federal tax deductions under the Internal Revenue Service (IRS) code known as 280E, it would not federally legalize marijuana, as the&nbsp;<a href="https://www.marijuanamoment.net/marijuana-businesses-could-advertise-in-newspapers-and-magazines-if-rescheduling-is-approved-congressional-researchers-say/">Congressional Research Service (CRS) has made known in multiple recent reports</a>.
Meanwhile, two additional congressional lawmakers have joined the ranks of GOP members who are challenging what they say is&nbsp;<a href="https://www.marijuanamoment.net/gop-lawmakers-demand-answers-from-biden-administration-about-unusual-marijuana-review-process-behind-rescheduling-push/">the "unusual" process that led the Biden administration to propose rescheduling marijuana</a>, expressing concern about how the review was carried out and demanding answers.
Rep. Doug LaMalfa (R-CA)&nbsp;<a href="https://www.marijuanamoment.net/gop-congressman-says-marijuana-rescheduling-and-banking-reform-would-prop-up-an-immoral-industry/">condemned the Biden administration's push to reclassify marijuana</a>, as well as legislative efforts to enact bipartisan cannabis banking reform, because he says the policy changes would "prop up this immoral industry" and give a "green light to the evil that comes from drug use."
Sen. Bill Cassidy (R-LA) also blasted the Biden administration over what he described as&nbsp;<a href="https://www.marijuanamoment.net/gop-senator-condemns-lack-of-transparency-in-marijuana-rescheduling-process/">repeated refusals from federal agencies to brief Congress</a>&nbsp;on its plans and justification for rescheduling marijuana, which he argues fuels speculation that the proposed policy change is politically motivated.
Similarly, 25 GOP congressional lawmakers sent a public comment letter in July opposing the administration's planned rescheduling of marijuana, specifically alleging&nbsp;<a href="https://www.marijuanamoment.net/gop-lawmakers-push-justice-department-to-reverse-course-on-marijuana-rescheduling/">the government's recommendation was based on politics rather than science</a>.

This agreement is a key step for Gro-Vida to position itself in Germany&#8217;s growing medical marijuana market while supporting Canopy Growth GmbH&#8217;s strategy of securing EU-based supply through an asset-light approach in addition to existing supply from the company's Canadian GMP production platform.

Products will be available via prescription and can be requested by patients nationwide in Germany from their healthcare practitioner beginning in calendar Q1 of 2025.

A recent <a href="https://prohibitionpartners.com/reports/the-german-cannabis-report/" target="_blank" rel="noreferrer noopener">report</a> on Germany&#8217;s cannabis market by Prohibition Partners revealed that German medical marijuana sales are projected to reach €420 million in 2024 ($260.66 million) reaching €1 billion by 2028.
The report comes several months after major cannabis reform in Germany with the implementation of the Cannabis Act (CanG) and the associated MedCanG Act. Partial cannabis legalization <a href="https://www.benzinga.com/markets/cannabis/24/04/38023610/heres-what-you-need-to-know-about-weed-legalization-in-germany-that-just-took-effect" target="_blank" rel="noreferrer noopener">took effect in Germany on April 1</a>, allowing people over 18 to legally possess up to 25 grams of dried cannabis and cultivate up to three plants at home. Historically, approximately 40% of imported cannabis in Germany has been either rejected or re-exported, with pharmacies purchasing about 60% of imports, according to analyst <a href="https://zuanicgroup.com/">Pablo Zuanic</a> of Zuanic and Associates.
In Q3 2024, as importers rushed to build inventories, rejection rates likely increased, potentially resulting in pharmacies purchasing between 50% and 55% of imports. 
This suggests that out of the 20.1 tons imported, pharmacies acquired between 10 and 11 tons, doubling the levels seen before the April reforms.
<h3 class="wp-block-heading">Shifts In Exporter Market Shares</h3>
<a href="https://www.benzinga.com/topic/canada-cannabis">Canada</a> remains the largest supplier, exporting 8.1 tons to<a href="https://www.benzinga.com/topic/germany-cannabis"> Germany</a> in Q3 2024. However, its market share declined to 40% from 59% in Q1.&nbsp;Several Canadian companies actively operate in Germany's cannabis market, including Aurora Cannabis Inc. (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/ACB#NASDAQ">ACB</a>), Canopy Growth Corporation (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/CGC#NASDAQ">CGC</a>), and Tilray Brands Inc. (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/TLRY#NASDAQ">TLRY</a>), leveraging their expertise in cultivation and distribution to meet the growing demand.

Zuanic explains that if Germany reaches a 1% penetration rate, similar to Canada&#8217;s, "that would imply more than 4-5x upside." However, achieving this growth will require <a href="https://www.benzinga.com/general/biotech/24/08/40298228/think-you-can-do-it-all-20-000-reasons-why-automation-outperforms-a-broad-approach-in-cannabis">addressing key challenges</a>. "More consistent and ample supplies across price and quality spectrums, new formats being allowed, and streamlined prescription systems."
Despite these hurdles, Zuanic says he is still optimistic. "It is still early days, but the German medical cannabis market could accelerate as these issues along the supply chain improve," he added, signaling the potential for significant expansion in this nascent market.

Canopy Growth Acquisition Target Acreage Reports 30% YoY Decline In Q3, Record Cannabis Wholesale Revenue In NY

Senate Republicans on Wednesday <a href="https://www.marijuanamoment.net/every-gop-senate-majority-leader-candidate-opposes-marijuana-legalization/">elected a new majority leader who not only opposes legalizing marijuana</a> but has also called for a reversal of the Biden administration's plan to reschedule cannabis and has criticized Democrats for working to increase the industry's access to banking services.
Thune, who defeated Sens. John Cornyn (R-TX) and Rick Scott (R-FL) in an election for the leadership slot, joined other GOP lawmakers in a letter in July <a href="https://www.marijuanamoment.net/gop-lawmakers-push-justice-department-to-reverse-course-on-marijuana-rescheduling/">challenging the current administration's marijuana rescheduling push</a>, urging that the policy proposal be trashed.
The rescheduling rule "fails to provide adequate science and data to support moving marijuana to schedule III and should not have been signed or published," the letter Thune signed says, calling it "irresponsible" for federal health officials to "make this determination when emerging research shows that there are significant health concerns associated with marijuana use."
The letter details Thune's and other Republican lawmakers' concerns about marijuana's health effects, suggesting that there is a "clear association between cannabis use and psychosis, anxiety, cognitive failures, respiratory adverse events, cancer, cardiovascular outcomes and gastrointestinal disorders."
It also claims that "sexual disfunction was twice as high in men who used marijuana" and that "marijuana use among veterans with PTSD was associated with worse PTSD symptoms, more violent behavior, and alcohol use."
Beyond criticizing cannabis use and policy reform, the letter Thune signed further calls into question whether marijuana has any medical value.
"Medical marijuana dispensaries sell edibles and vapes that come in flavors like passion raspberry, blueberry calm, wild cherry, and sour apple," it says. "Pretending that these products are medicine that can treat health conditions is doing a disservice to Americans."
"It remains the case that marijuana has no currently accepted medical use," Thune and his Republican colleague wrote. "The fact that states have labeled marijuana as ‘medicine' does not change the nature of the drug… We urge you to withdraw this proposal and maintain marijuana as a schedule I drug."
Separately, as Senate Democrats moved to advance a marijuana legalization bill in 2021, Thune <a href="https://twitter.com/JulieNBCNews/status/1384583108410978312">said</a> that cannabis reform is "something we'll probably have to grapple with here." But he's consistently opposed even modest proposals to allow marijuana industry banking.
Earlier this year, Thune said attaching cannabis banking legislation to an aviation bill would be "a non-starter," <a href="https://www.bloomberg.com/news/newsletters/2024-05-01/pot-industry-banking-bill-still-in-limbo-but-not-dead-yet">noting</a> that Republican&nbsp; opposition to the idea is "very strong."
He <a href="https://www.congress.gov/congressional-record/volume-166/issue-96/senate-section">called</a> the then-Democratic-controlled House's proposal to include marijuana banking reform in a large-scale coronavirus relief bill "crazy stuff" in 2020, complaining in a floor speech that the text of the underlying legislation mentions "cannabis" more times than "jobs."
"In case Democrats didn't realize, Americans aren't suffering from a lack of cannabis right now," Thune <a href="https://www.thune.senate.gov/public/index.cfm/2020/5/thune-senate-focused-on-american-people-while-house-is-distracted-by-liberal-agenda">said</a> in a speech on the Senate floor. "They're suffering from a lack of employment."
He also said that Democrats' push to advance a marijuana legalization bill was a "great illustration of the gap in priorities."
"While Republicans are continuing to negotiate on COVID relief, Democrats are holding votes on a Tiger King bill &amp; legalizing cannabis," he said. "Let's get serious &amp; do our job for Americans."
Back in 2014, Thune said that while he understands that "people have strong opinions on both sides of this debate, I do not support legalizing the use of marijuana."
"Currently, the medical benefits from the use of marijuana are still inconclusive, and I believe that we must be careful not to increase the availability of marijuana and the use of marijuana for non-medical reasons," the senator <a href="https://www.facebook.com/permalink.php?story_fbid=1423720604579857&amp;id=1374412469510671">said</a> in a constituent letter. "However, I support the development of alternative medications that will provide relief to patients without opening the door to substance abuse."
The next year, he called legalization a "dangerous path," <a href="https://vote.norml.org/politicians/398">adding</a> that voters who enacted the reform in Colorado are "going to pay a price for it."
In 2021, Thune acknowledged that cannabis is an "area that's still evolving, and our country's views on it are evolving," <a href="https://www.politico.com/news/2021/06/27/republicans-weed-496390">adding</a> that "how we deal with it nationally I think is still an open question."
"Medical's getting big — the recreational not as big yet, but it's growing — and there'll be more initiatives on the ballot," he said.
For what it's worth, voters in Thune's home state of South Dakota approved a marijuana legalization initiative at the ballot in 2020, but it was overturned by the state Supreme Court. U.S.-focused cannabis stocks and ETFs <a href="https://www.benzinga.com/markets/cannabis/24/11/41775201/cannabis-reform-stumbles-in-2024-elections-a-state-by-state-breakdown-as-stocks-take-a-hit">may have taken a dip</a> in pre-market trading on Wednesday in response to <a href="https://www.benzinga.com/news/24/11/41768178/donald-trump-defeats-kamala-harris-to-win-2024-election">2024 U.S. election outcomes</a>. <h3 class="wp-block-heading">Canopy Growth</h3>
Canopy Growth Corporation (TSX:<a class="ticker" href="https://www.benzinga.com/stock/WEED#TSX">WEED</a>) (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/CGC#NASDAQ">CGC</a>) will report the second quarter of fiscal year 2025 ended Sept. 30, before financial markets open&nbsp;on Friday, Nov. 8, 2024.
The Canadian cannabis giant will host an audio webcast with CEO David Klein, who recently announced his plan to <a href="https://www.benzinga.com/markets/cannabis/24/08/40419783/canopy-growth-ceo-departure-leaves-nasdaq-listed-company-poised-for-profit-surge-what-investors-">retire at the end of the company&#8217;s fiscal year</a> on March 31, 2025, and CFO Judy Hong the same at 10 am Eastern Time.
Canopy's first quarter earnings report made public in August showed Canadian medical marijuana revenue surged 20% year-over-year. Over the same period, the company has been amping up its efforts to expand in the U.S. market via the Canopy USA business unit.
Canopy USA, LLC has completed its acquisition of Wana last month. The deal included Wana Wellness, LLC, The CIMA Group, LLC, and Mountain High Products, LLC. The top edibles brand, Wana, generated roughly $150 million in retail sales across 19 states in 2023.
Combined with the <a href="https://www.benzinga.com/markets/cannabis/24/10/41251114/cannabis-giant-canopy-expands-us-presence-with-acquisition-of-top-edibles-brand-what-it-means-fo">wrapped-up acquisition</a> of roughly 75% of the shares of cannabis edibles producer,&nbsp;Lemurian, Inc. (Jetty) as <a href="https://www.benzinga.com/markets/cannabis/24/06/39166300/canopy-growth-doubles-down-on-its-usa-strategy-announces-exercise-of-acreage-options">announced this past June</a>, Canopy USA has fulfilled its plan to set up a brand-focused cannabis company in the U.S.
The completed acquisitions of Wana and roughly 75% of the shares of Jetty, followed by the contemplated acquisition of Acreage Holdings, Inc., are expected to enable Canopy USA to boost its financial position.

Canopy made headlines earlier in October by making an early payment of $100 million on its senior secured loan at a <a href="https://www.benzinga.com/markets/cannabis/24/10/41381387/canopy-growth-slashes-debt-with-100m-loan-prepayment-saves-14m-in-interest">discounted price of $97.5 million</a>. The move reduced the company's debt and saved around $14 million in annual interest costs while highlighting its focus on financial discipline.

<h3 class="wp-block-heading">IM Cannabis</h3>
IM Cannabis Corp. (CSE:<a class="ticker" href="https://www.benzinga.com/stock/IMCC#CSE">IMCC</a>) (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/IMCC#NASDAQ">IMCC</a>) a medical cannabis company with operations in Israel and Germany, will report operational and financial results for the third quarter ended Sept. 30 on Nov. 14, 2024, before the market opens.
The company will host a Zoom web conference on the same day at 9:00 am Eastern Time to discuss the results, followed by a question-and-answer session for the investment community.
IM Cannabis announced a <a href="https://www.benzinga.com/markets/cannabis/24/07/39647965/im-cannabis-announces-major-share-consolidation-plan-what-investors-need-to-know">major share consolidation plan in June</a>. Its board of directors approved a consolidation of its issued and outstanding common shares under which every six pre-consolidated common shares will convert into one post-consolidated share. The company announced last month it intends to undertake a non-brokered private placement offering of up to $1,613,000 through the sale of roughly 625,000 units.
